Terms of Service

These Terms govern the User's use of the ZenGem application and website at zengem.ai (the "Service"), provided by ZenGem BV ("ZenGem"). By using the Service, the User agrees to these Terms. Questions? Email us at: [email protected].

1. The Service
ZenGem is a B2B marketing and sales application. The Service is intended for business use by professionals acting on behalf of an organization.

2. Account
The User is responsible for their account credentials and for all activity under their account. The User must provide accurate information and keep it up to date.

3. Acceptable use
The User agrees to use the Service lawfully and not to:

  • send unlawful, deceptive, or unsolicited bulk messages, or otherwise breach applicable anti-spam, privacy, or data-protection laws;

  • send content the User has no right to send;

  • attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.

The User is responsible for the content they send and for having a lawful basis to contact their recipients.

4. Connected accounts
If the User connects a third-party account or service to the platform, the User authorizes ZenGem to act on the User's behalf in connection with that account, only as described in ZenGem's Privacy Policy. The User's use of those third-party services remains subject to their own terms. The User can disconnect at any time.

5. Intellectual property
ZenGem owns the Service and all related intellectual property. The User retains ownership of the content and data the User provides, and grants ZenGem the limited rights needed to operate the Service for the User.

6. Availability and changes
ZenGem aims to keep the Service available but does not guarantee uninterrupted operation. ZenGem may modify or discontinue features, and may update these Terms; material changes will be notified in the Service or by email.

7. Disclaimer and liability
The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by Dutch law, ZenGem is not liable for indirect or consequential damages. Any specific commercial terms are set out in the separate agreement between the User and ZenGem.

8. Termination
The term and termination of the Service are governed by the agreement between the User and ZenGem. ZenGem may suspend or terminate access if the User breaches these Terms.

9. Governing law
These Terms are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the District Court of The Hague (Rechtbank Den Haag), the Netherlands.
